The Brazilian Environment and Renewable Natural Resources Institute (IBAMA) is a federal autarchy equipped with public law legal character, administrative and financial autonomy, bound to the Ministry of Environment, according to Art. 2 of the Law No. 7.735, of February 22nd, 1989. It main assignments are to exercise the power of environmental police; execute the actions of the national environmental policies, related to the environmental licensing and execute the supplementary actions ruled by the Federal Government according to the environmental legislation in force, in accordance to the Law No. 11.516, of August 28th, 2007.
Bodies merger: Sema, IBDF, Sudepe and Sudhevea, these were the four bodies that gave rise to IBAMA.
The Federal Technical Registry – CTF is one of the instruments of the National Environmental Policy (Art. 9 of the Federal Law 6.938/81) in order to ensure the environmental control and monitoring of the potentially polluting activities using the natural resources, as well as the extraction, production, transportation and commercialization activities of production potentially hazardous to the environment or that use products and sub-products of the fauna and flora.
According to article 17-C of the Federal Law 10.165/00, every individual or legal entity developing activities potentially polluting, as well as extraction, production, transportation and commercialization of products potentially hazardous to the environment or that use products and sub-products of the fauna and flora shall be registered. Through the Normative Instruction No. 07, of July 7th, 2011, IBAMA altered the Normative Instruction No. 31, of December 3rd, 2009, in order to determine if individuals or legal entities that dedicate activities potentially polluting and/or extraction, production, transportation and commercialization of products potentially hazardous to the environment, as well as products and sub-products of the fauna and flora, and other activities susceptible to IBAMA control and state and city environmental bodies are subjected to the Federal Technical Registry.
Therefore, every individual and legal entities that perform activities subjected to the following are subjected to the Federal Technical Registry - CTF: Environmental licensing by IBAMA, of the state or city environmental body / Specific IBAMA authorization or the state forest bodies.
